Indian Supreme Court rejects petition for independent investigation into Pahalgam attack

In a significant development, the Supreme Court of India on April 30 rejected a petition seeking the formation of a Special Investigation Team (SIT) to investigate the Pahalgam attack which led to 26 deaths.

Indian citizens filed a Public Interest Litigation (PIL) petition for constitution of an SIT headed by retired judges who would probe the Pahalgam attack independently to find out the truth.

However, the Indian Supreme Court Justice Surya Kant refused to hear the petition, instead scolding the responsible citizens, saying, “Be responsible before filing such PILs (public interest litigation). You have a duty towards the country also. Is this the way you want to demoralize our forces? Since when did we get expertise for this investigation?”

The petitioners, Fatesh Kumar Shahu, Mohammad Junaid, and Vicky Kumar argued that the Court should accept the plea, stating that the Indian Occupied Kashmiris were being targeted following the Pahalgam attack.

It merits a mention that the extremists across Indian Occupied Kashmir have targeted local Kashmiri students and youth after Pahalgam incident.

‘This is not the time. This is the crucial hour when each citizen has joined hands… this is not acceptable to us. Look at the sensitivity of the issue…” stated the Indian Justice while refusing to conduct an independent inquiry into the Pahalgam incident.

It must he highlighted that Pakistan has officially condemned “terrorism in all its forms and manifestations” multiple times following the Pahalgam incident; however, the Indian government continues to blame Pakistan without providing any evidence.

Almost eight days have passed since the Pahalgam incident on April 22, and the Indian authorities have failed to apprehend the militants responsible for the attack.

One analyst on Indo-Pak tensions responded to the development on X by writing, “This is revealing: Indian Supreme Court refuses to conduct judicial probe into the Pahalgam terror attack and appears to be more concerned about the morale of the Indian forces than helping provide answers to those affected by the terror attack.”
